On Behalf of | Oct 11, 2013 | Wrongful Death

A Georgia teenager is dead and his brother has been injured after a distracted driver left the road and collided with them. Local police are investigating the crash, and the driver is now facing homicide charges.

The fatal accident occurred on Oct. 10, around 11 a.m. According to reports, two young boys from Evans, one aged 14 and the other 6, were on the shoulder of Hardy McManus Road. The older brother was sitting on a go-kart while the younger boy stood nearby. A 58-year-old North Augusta man was distracted while driving his pickup eastbound on the road. The pickup left the road and collided with the go-kart, then stopped in a roadside embankment.

Witnesses at the scene say that the older boy was pinned beneath the rear wheel of the man’s pickup. They freed the boy and administered first aid. Emergency personnel flew the boy to Georgia Regents Medical Center, but he was pronounced dead just over an hour after the accident. The extent of the younger brother’s injuries are unknown, but one witness believes that they are not serious. The driver has been charged with vehicular homicide in the first degree. Police are continuing to investigate the fatal accident, and an autopsy is planned for the boy by the Georgia Bureau of Investigation Crime Lab.

When a driver is negligent and causes a fatal car crash, they may be liable for damages from the loss of a loved one, such as loss of companionship and pain and suffering. An attorney who has experience with wrongful death actions may be able to investigate the accident and assign fault. The attorney may then be able to recover these damages, either through settlement with the negligent party or by bringing a successful lawsuit.
