When negligence results it the loss of a loved one in Georgia

On Behalf of | Apr 7, 2016 | Wrongful Death

“Tragedy” is a word that is, unfortunately, being used all too frequently in America these days. It seems like President Obama is ordered flags to be flown at half-mast almost every other month because of a tragedy that plays out in some part of the country. As Americans we all grieve during these national tragedies, but it can be easy to overlook the fact that every day in this country there are families experiencing their own personal tragedies. A fatal car crash probably takes place every day in America, leaving a family grieving over the loss of a loved one.

It is when these deaths are attributable to an act of negligence that the word “tragedy” is usually attached — a senseless death, one that could have been avoided or prevented. Fatal truck accidents occur when truck drivers operate their rigs while fatigued. Fatal motorcycle accidents occur because other motorists aren’t on the lookout for the presence of motorcycles on the roads. And, fatal car accidents occur, all too often, due to drunk drivers.

What can the family of a person who was killed in a fatal accident do besides mourn? How should they respond to the negligence that led to that family member’s death? In some cases, a legal cause of action for a wrongful death claim may be an option.

In pursuing a wrongful death claim, a family may attempt to recover financial compensation for many different reasons. They may pursue damages for the pain and suffering the deceased family member experienced prior to death. They may pursue damages for loss of companionship. And, they can also pursue damages for any medical or burial expenses that were incurred — among many other types of compensation that may be available.
